Porch Pick Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Hermitage Studios, LLC ("Hermitage Studios," "we," "us," or "our"), the operator of the Porch Pick marketplace, governing your access to and use of the Porch Pick mobile application, website, and related services (collectively, the "Service"). "Porch Pick" refers to the marketplace and Service operated by Hermitage Studios, LLC. When "Porch Pick" is used as a party to these Terms (including in Sections 24 and 28–30), it means Hermitage Studios, LLC. By creating an account, listing an item, making a purchase, or otherwise using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service.
1. About the Service
Porch Pick is an online marketplace where individuals ("Sellers") list and sell pre-owned and new children's and baby clothing, footwear, and clothing accessories (such as hats and bonnets) to other individuals ("Buyers"). We provide the platform, payment facilitation, shipping tools, search, and related features.
Porch Pick is not the seller of any item. The sales contract for any item is between the Buyer and the Seller. We do not take title to or possession of items. We facilitate transactions; we do not guarantee them except as expressly stated in these Terms.
2. Eligibility
You must be at least 18 years old to use the Service. When you register, you must affirmatively confirm that you are 18 or older; we record that confirmation. The Service is not directed to and may not be used by anyone under 18. Sellers must also satisfy the requirements of our payment processor (Section 11).
3. Beta Service; United States Only
The Service is offered as a beta, on an "as-is" and "as-available" basis, only to users located in the United States. Features may change, be limited, or be discontinued at any time. We do not guarantee availability, uptime, or that the Service will be error-free during the beta period. Do not use the Service outside the United States.
4. Account, Verification & Security
4.1 Account. You must register with accurate information and keep it current. You are responsible for all activity under your account.
4.2 Seller payout onboarding (Stripe Connect). To sell and receive payouts, you must onboard to Stripe Connect and accept the applicable Stripe agreements (Section 11). Identity and financial information required for payouts — such as legal name, date of birth, tax identifier, and bank account — is collected and verified directly by Stripe through its onboarding, not stored by Porch Pick. You authorize us and Stripe to verify your identity as required by law.
4.3 Device integrity. We may use Apple App Attest to record a device-integrity signal when you sign in, to help deter automated abuse and fraudulent accounts.
4.4 Right to suspend or withhold. We may refuse, suspend, or terminate accounts, remove listings, or withhold, delay, or reverse payouts if verification fails or cannot be completed, if we suspect fraud or misrepresentation, or for violations of these Terms.
4.5 Security. Keep your credentials confidential and notify us promptly of unauthorized use. We are not liable for losses arising from your failure to safeguard your account.
5. Buying on Porch Pick
5.1 Placing an order. When you buy, you agree to pay the item price plus shipping and any applicable tax shown at checkout, and you authorize the charge to your payment method. Shipping is charged at $7.50 for the first item plus $1.00 for each additional item in the same order, as shown at checkout. Some listings offer free shipping (funded by the Seller); when every item in your order has free shipping, you pay $0 shipping. (Each order contains items from a single Seller.)
5.2 The sale is between you and the Seller. Items are pre-owned or handled by individual Sellers and may show normal wear as described.
5.3 Delivery, inspection, and release of payment. After a carrier confirms delivery, payment is held for 3 days before it is released to the Seller. During that period you may report a problem under Buyer Protection (Section 14), or you may accept the delivery to release payment to the Seller sooner. If you take no action and no dispute is open, payment is released to the Seller after the hold period and the order is deemed accepted.
6. Selling on Porch Pick
6.1 Your listings. You are solely responsible for the accuracy and completeness of your listings, including brand, size, condition, materials, measurements, photos, and price. You represent that you own the item and may lawfully sell it, that it is authentic (not counterfeit), that it is described accurately, and that its sale complies with all laws, including the safety requirements in Section 9. Listing details are entered by you (the Service does not auto-generate them).
6.2 Fulfillment and shipping deadline. When an item sells, you must promptly ship the item, in the condition described in your listing, using the provided shipping label (Section 13). If you do not ship within 7 days, the order may be automatically cancelled and the Buyer refunded, and repeated failures may result in account action.
6.3 Selling formats. Certain features or formats (for example, promoted listings or auction-style listings, where available) may be subject to additional rules presented in the app.
7. Offers and Counteroffers
The Service may allow Buyers to submit offers on listings and Sellers to accept, decline, or counter them, and may allow Sellers to send offers to users who saved or liked a listing. Offers may expire after a period shown in the app. An accepted offer is a binding commitment to transact at the agreed price, subject to these Terms.
8. Visual Pattern Match and Saved Searches
8.1 What it does. "Pattern Match" lets you upload a photo to find current listings that look visually similar and to create a saved search (an "Item Watch") that notifies you when similar new listings appear. Certain Pattern Match usage may require a membership or purchased credits (Section 17).
8.2 How it works. To provide this feature, we process the photo you submit and listing images using automated image-analysis technology, including Google Cloud Vision (which detects visual labels and dominant colors) and perceptual image hashing, to estimate visual similarity.
8.3 Your photos are stored. The photo you submit to Pattern Match is stored on our infrastructure to run the search and power Item Watch alerts, along with derived data (labels, colors, image hashes). You can delete a saved Item Watch in the app, which removes its stored images. See the Privacy Policy for details and retention.
8.4 Results are estimates only. Pattern Match finds images that appear visually similar. It does not identify, authenticate, appraise, or verify the brand, size, condition, or value of any item, and a match does not guarantee the items are the same.
8.5 Consent. By submitting a photo to Pattern Match, or by creating a listing, you permit Porch Pick and its image-analysis providers to process the image to provide these features.
9. Prohibited Items & Children's Product Safety
Porch Pick lists only children's and baby clothing, footwear, and clothing accessories; other categories (including bedding, cribs, car seats, toys, furniture, and baby gear) may not be listed. Because these are children's products, safety is a core requirement. You may not list, sell, or ship:
- Any item that has been recalled by the U.S. Consumer Product Safety Commission (CPSC) or a manufacturer, or that is subject to a stop-sale or safety notice;
- Children's sleepwear that does not meet applicable flammability standards;
- Items with drawstrings, small detachable parts, or other choking, strangulation, or entanglement hazards contrary to CPSC guidance for children's products;
- Counterfeit, replica, or unauthorized-brand goods, or items infringing intellectual-property rights;
- Used items that are unsanitary or unsafe for children;
- Any item whose sale is restricted or prohibited by federal, state, or local law.
You represent that every item you list complies with the Consumer Product Safety Improvement Act (CPSIA) and applicable CPSC regulations. We may remove listings, refund Buyers, and suspend accounts for violations.
10. Fees
10.1 Seller fees. Porch Pick charges Sellers a fee on completed sales: 15% of the item price for items priced over $15, or a flat $2.50 for items priced $15 or less, calculated on the item price (after any bundle discount) and deducted from the Seller's payout.
10.2 Buyer costs. Buyers pay the item price, a shipping charge of $7.50 for the first item plus $1.00 per additional item (or $0 when every item in the order offers Seller-funded free shipping), and applicable tax shown at checkout. Buyers pay no separate marketplace fee.
10.3 Changes. Fees are shown before you confirm a listing or purchase and may change prospectively with notice.
Fees for optional memberships and credits are described in Section 17.
11. Payments, Payouts & Stripe Connect
11.1 Payment processing. Payments are processed by Stripe. By buying or selling, you agree to Stripe's applicable terms, including the Stripe Services Agreement and, for Sellers, the Stripe Connected Account Agreement, incorporated by reference. You must comply with them as a condition of using the Service.
11.2 Seller payouts. After a sale completes and the applicable hold (Section 12) passes, the Seller's net proceeds are transferred to the Seller's Stripe balance. Withdrawal to your bank is a separate step you initiate; timing of bank transfers is controlled by Stripe and your bank and is not guaranteed by Porch Pick.
11.3 Holds, reversals, chargebacks, negative balances. We and Stripe may hold, delay, reserve, or reverse funds to address disputes, chargebacks, refunds, suspected fraud, or Terms violations. If a refund is due after a Seller has been paid, the corresponding transfer may be reversed. You are responsible for chargebacks and negative balances and authorize recovery, including by deducting from current or future payouts.
11.4 Not a bank. Porch Pick is not a bank, money transmitter, or fiduciary. Funds handled in connection with a transaction are not deposits and are not FDIC-insured.
12. Holding of Funds
For each purchase, payment is held until 3 days after the carrier confirms delivery, then released to the Seller, unless the Buyer accepts delivery sooner (releasing payment early) or a dispute or chargeback is open (which extends the hold until resolved). Porch Pick holds funds solely to operate the marketplace and not as an escrow agent or fiduciary except as required by law.
13. Shipping
13.1 Labels via Shippo. Shipping labels are generated through our provider, Shippo, and its carrier partners. When an item sells, a prepaid label is made available to the Seller.
13.2 Seller responsibilities. Sellers must ship promptly to the address provided, using the designated label, and are responsible for accurate package weight and dimensions and proper packaging. Providing incorrect information may cause delays, additional charges, or non-delivery.
13.3 Adjustments and surcharges. Carriers may assess adjustments or surcharges (for example, for incorrect weight or dimensions). You authorize us to bill such adjustments to the responsible party, including by deducting from payouts.
13.4 Loss and carrier terms. Neither Porch Pick nor Shippo is a carrier. Delivery timing, tracking, risk of loss, and handling of undeliverable or returned packages are subject to the carrier's terms.
13.5 Address sharing. To ship, both parties' names and postal addresses (and phone numbers as required by the carrier) are shared as needed to fulfill the order.
14. Buyer Protection
Porch Pick offers a Buyer Protection policy for transactions that go wrong. It is not insurance.
14.1 What qualifies. A Buyer may open a case if the item was not received (for example, marked delivered but never received), is significantly not as described, arrived damaged (undisclosed), is the wrong item, is counterfeit, or has another problem with the transaction, which the Buyer must describe when opening the case. Not every reported problem results in a refund (Section 14.3). Normal disclosed wear, minor variation, and buyer's remorse are not eligible.
14.2 Who and how to file. Only the Buyer may open a case, and only once the order is marked delivered or completed. If an order is never marked delivered, you do not need a case: the Seller is not paid (funds are released only after confirmed delivery), an order the Seller does not ship within 7 days is automatically cancelled and refunded (Section 6.2), and if a shipment appears lost in transit you can contact support@porchpick.com to resolve the order, including a refund where appropriate. The Buyer selects a reason and provides a written description of the problem. A case must be opened within 3 days of delivery; after that window closes, contact support@porchpick.com for help with the order. Funds remain held while a case is open.
14.3 Review and outcomes. Porch Pick staff review the case and may contact both parties; case handling is not automated and is not subject to a fixed turnaround. We may refund the Buyer (in full or in part) and withhold or reverse the Seller's payout, ask the Buyer to return the item, record a warning to the Seller, or close the case without a refund if it is not substantiated. Refunds are issued to the original payment method through Stripe.
14.4 Finality and abuse. Our decision is final for purposes of this policy, subject to Section 31. Abuse — including false claims or failure to return items — may result in denial, reversal of refunds, and account action.

15. Returns, Cancellations & Refunds
Except as provided under Buyer Protection (Section 14) or required by law, sales are final. A Buyer may cancel an order within 3 hours of purchase, before it progresses, and may also cancel an order the Seller has not shipped within 7 days of purchase; other cancellations are described in the Buyer Protection & Dispute Policy. If a shipping label is already active for the order, the cancellation refund may be held for up to 24 hours while we confirm with the carrier that the package is not already in transit; a carrier scan during that window continues the order instead of cancelling it. If a Seller does not ship within the required window (Section 6.2), the order is automatically cancelled and the Buyer refunded. Approved refunds — full or partial — are issued to the original payment method through Stripe and may take several business days to appear; where a Seller was already paid, the corresponding transfer is reversed.
16. Taxes
Where required, sales tax is calculated and collected at checkout and remitted through our payment and tax processors under marketplace-facilitator rules. Sellers remain responsible for their own income and other tax obligations and for providing accurate tax information; tax forms, where applicable, may be issued by Stripe. Nothing here is tax advice.
17. Membership and In-App Purchases
17.1 Porch Pick membership. We offer an optional paid membership (the "Verified" tier) that unlocks additional features (which may include a monthly allotment of Pattern Match searches, an ad-free experience, priority match alerts, early access to matched inventory, Item Watches, and listing promotion). Membership is an auto-renewing subscription sold through Apple In-App Purchase. Members may display a “Verified” badge on their profile and listings while their membership is active.
17.2 Billing, renewal, and cancellation (Apple). The subscription price is $4.99 per month (or, if different, the price shown in the App Store at the time of purchase). New subscribers may be offered an introductory free-trial period as shown at purchase; after the trial ends, the subscription automatically renews at the stated price unless you cancel before the trial ends. Payment is charged to your Apple ID account at purchase and automatically renews each period unless you cancel at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the period ends. You manage and cancel your subscription in your Apple ID Settings; deleting the app does not cancel it. If a renewal payment fails, Apple may provide a grace period during which access continues while payment is retried.
17.3 Purchased credits ("Match Packs"). You may buy consumable Pattern Match credits through Apple In-App Purchase. Credits are consumable, non-refundable, and non-transferable, and are applied to your account after Apple confirms the purchase.
17.4 Refunds for IAP. Purchases made through Apple are subject to Apple's refund policies; Porch Pick does not process refunds for Apple In-App Purchases. Referral or promotional membership benefits have no cash value.
18. Reviews and Ratings
After a completed order, a Buyer may leave a rating (1–5 stars) and review of the Seller. Reviews must be honest, based on the actual transaction, and must not contain unlawful, infringing, harassing, or personal-data content. Five-star reviews (“Love Notes”) are displayed publicly on Seller profiles; ratings below five stars are shared privately with the Seller and are not displayed publicly — but every rating counts toward the Seller’s public average rating and review count. Reviews may be aggregated into Seller statistics and badges. You grant Porch Pick a license to display and use reviews as User Content (Section 21). We may remove reviews that violate these Terms; to report a review, contact support@porchpick.com.
19. Referral Program
We may offer a referral program in which referring and referred users can earn benefits when a referred user completes a qualifying first purchase. The current reward is 30 days of premium features for both the referring and referred user per qualifying referral (plus limited AI-match and Item Watch benefits); a referrer’s premium period extends by 30 days for each additional qualifying referral. Each account may be referred only once and earns the reward only on its first qualifying purchase. Referral benefits are non-cash, non-transferable, may be limited, changed, or discontinued at any time on a going-forward basis, and are void for self-referral, fraud, or abuse.
20. Messaging and Communications
The Service includes direct messaging between Buyers and Sellers to support transactions. You agree not to use messaging for spam, harassment, off-platform circumvention of fees, or unlawful content. Porch Pick Support may access messages for dispute resolution, safety, and service improvement, as disclosed in the app and the Privacy Policy. Messaging for an order remains available while a case is open, so both parties can communicate, and may be disabled once the case is resolved or a refund is issued. We do not pre-screen messages but may act on reports (Section 23).
21. User Content & License
21.1 Your content. You retain ownership of the photos, text, reviews, and other content you submit ("User Content"). You represent that you have the rights to submit it and that it does not infringe others' rights or violate these Terms.
21.2 License to Porch Pick. You grant Porch Pick a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, adapt, and use your User Content to operate, provide, and promote the Service, including processing images through the automated image-analysis systems described in Section 8.
21.3 Removal. We may remove User Content that violates these Terms or that we reasonably believe creates legal or safety risk.
22. Prohibited Conduct
You agree not to: violate any law or these Terms; post false, misleading, infringing, or unsafe content; sell prohibited or unsafe items (Section 9); circumvent fees or transact off-platform; harass, defraud, or impersonate others; interfere with or attempt to compromise the Service or its security (including App Attest or verification); scrape or misuse data; or create accounts to evade suspension.
23. Reporting, Blocking & Safety
You can report users or listings (for reasons including spam or scams, inappropriate or offensive content, harassment, fraud, and counterfeits) and block other users. We may investigate reports and take action, including removing content, restricting features, and suspending accounts. Reporting tools do not replace contacting law enforcement where appropriate.
24. Intellectual Property
The Service, including its software, design, logos, and content (excluding User Content), is owned by Porch Pick or its licensors. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose. You may not copy, modify, reverse-engineer, or create derivative works except as permitted by law.
25. Copyright, Counterfeit & DMCA
We prohibit counterfeit and infringing listings. If you believe content infringes your copyright, send a notice with the information required by the Digital Millennium Copyright Act (DMCA) to our designated agent at dmca@porchpick.com (or by mail: DMCA Agent, Hermitage Studios, LLC, c/o Northwest Registered Agent Service, Inc., 212 W. Troy St., STE B, Dothan, AL 36303). We respond to valid notices, remove infringing content, and terminate repeat infringers.
26. Notifications & Electronic Communications
You consent to receive communications electronically, including transactional messages about your account and orders. Push notifications require your device permission and can be tuned by category in the app or turned off in device settings. We send transactional email through our email provider.
27. Suspension & Termination
We may suspend or terminate access, remove listings, cancel transactions, or withhold or reverse payouts, with or without notice, for violations, suspected fraud, failed verification, or legal/safety risk. You may stop using the Service at any time and may delete your account in the app. Obligations that by their nature survive — including payment, fees, indemnity, disclaimers, limitations of liability, and dispute resolution — survive termination.
28. Disclaimers
THE SERVICE AND ALL ITEMS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTY REGARDING THE ACCURACY OF LISTINGS OR OF PATTERN MATCH / IMAGE-ANALYSIS RESULTS. PORCH PICK DOES NOT WARRANT THE CONDITION, SAFETY, LEGALITY, OR AUTHENTICITY OF ITEMS SOLD BY SELLERS. Some jurisdictions do not allow certain disclaimers, so some may not apply to you.
29. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORCH PICK AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF $100 OR THE FEES YOU PAID TO PORCH PICK IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
30. Indemnification
You agree to indemnify and hold harmless Porch Pick and its affiliates, officers, and employees from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your listings or items, your User Content, or your violation of these Terms or of any law or third-party right.
31. Dispute Resolution
Before filing any claim, you agree to first contact us at support@porchpick.com and attempt in good faith to resolve the dispute informally within thirty (30) days. Any dispute arising out of or relating to these Terms or the Service that cannot be resolved informally will be brought exclusively in the state or federal courts located in Alabama, and you and Hermitage Studios, LLC consent to the jurisdiction of those courts. A binding arbitration provision and class-action waiver may be added in a future update to these Terms.
32. Governing Law
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-laws rules, except as otherwise required by applicable consumer-protection law.
33. Changes to Terms
We may update these Terms. Material changes will be notified through the Service (including, where used, a re-acceptance prompt on next launch) or by other reasonable means. Continued use after changes take effect constitutes acceptance.
34. Privacy
Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and share information — including through Stripe, Shippo, Cloudflare Images, Google Cloud Vision, Algolia, Firebase, our email provider, and your device's camera and photos. The Privacy Policy is incorporated into these Terms.
35. General
These Terms, together with the Privacy Policy, Seller Policy, Marketplace Rules & Community Guidelines, Buyer Protection & Dispute Policy, and Copyright & DMCA Policy — each incorporated by reference — are the entire agreement between you and Porch Pick regarding the Service. If any provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.

Porch Pick Marketplace Rules & Community Guidelines

These Rules apply to everyone who uses Porch Pick. Breaking them can lead to content removal, warnings, feature restrictions, suspension, or account termination (Section 6).
1. Permitted Categories & Prohibited Items
Porch Pick is for children's and baby clothing, footwear, and clothing accessories (such as hats and bonnets) only. Other categories — including bedding, cribs, car seats, toys, furniture, and baby gear — may not be listed. Because these are children's products, item safety is a core rule. You may not list, sell, or ship: - anything outside the permitted categories above; - items recalled by the CPSC or a manufacturer, or subject to a stop-sale or safety notice; - children's sleepwear that does not meet flammability standards; - garments with drawstrings, small detachable parts (e.g., loose buttons or appliqués), or other choking, strangulation, or entanglement hazards contrary to CPSC guidance for children's apparel; - counterfeit, replica, or unauthorized-brand goods, or items that infringe intellectual-property rights; - stolen goods, hazardous materials, or anything whose sale is restricted or prohibited by law; - unsanitary or unsafe used items.
You represent that every item complies with the CPSIA and applicable CPSC regulations.
2. Prohibited Conduct
Do not: - post false, misleading, or inaccurate listings, or misrepresent an item's brand, authenticity, or condition; - harass, threaten, bully, or abuse others, or post offensive, hateful, or inappropriate content; - spam, scam, or engage in fraudulent activity; - circumvent fees or move transactions off-platform (e.g., soliciting payment by Venmo/PayPal/Zelle/cash or sharing contact details to complete a sale outside Porch Pick); - impersonate another person or misrepresent your identity or affiliation; - interfere with, probe, or attempt to compromise the Service or its security; - scrape or misuse data, or create accounts to evade enforcement.
3. Messaging Conduct
Messaging is for completing transactions. Do not use it to harass, spam, defraud, share prohibited content, or arrange off-platform sales. Porch Pick Support may access order-related messages to resolve disputes, investigate reports, and improve the Service, as disclosed in the Privacy Policy. Messages are not automatically screened for content (see Section 5); an admin tool may highlight messages that appear to solicit off-platform payment or share contact details, for human review.
4. Reviews and Reputation
Reviews must be honest and based on a real transaction. Do not post fake, incentivized, retaliatory, or off-topic reviews, or reviews containing unlawful content or others' personal information. Five-star reviews (“Love Notes”) are displayed publicly; ratings below five stars are shared privately with the Seller — every rating counts toward the Seller’s public average. Reviews may be removed for violating these Rules.
5. How We Enforce These Rules — Reports and Human Review
Uploaded images are automatically screened for explicit content (Google SafeSearch); flagged images are removed from processing and escalated for human review. Listing text, messages, and review text are not automatically screened. Beyond image screening, enforcement is primarily reactive and human-led: - Reporting. You can report a user or a listing for spam or scam, inappropriate content, harassment, fraud, offensive language, or counterfeit (or "other"). Reports are reviewed by Porch Pick staff, who may take action. - Blocking. You can block another user; blocking prevents that user from messaging you and hides interactions between you. - Automated behavioral rules. We use automated rules that act on transactional signals — such as disputes, refunds, reports, cancellations, and failed payments — not on message or listing content. When thresholds we configure are met, these rules may flag an account for review, send a warning, restrict features, or suspend the account.
We do not guarantee that we will detect or act on any particular content, and we are not responsible for user content we have not reviewed.
6. Enforcement Actions
Depending on the violation and history, we may: - remove listings or other content; - issue a warning; - restrict your ability to message, list, or buy, for a limited period or indefinitely; - suspend or terminate your account (a suspension signs you out and blocks access).
Restrictions may be time-limited and lifted automatically when they expire, or applied by our staff. Serious or repeated violations — especially safety violations, fraud, or counterfeits — may result in immediate termination.
7. Appeals
If you believe an enforcement action was taken in error, contact support@porchpick.com and we will review it. A formal appeals process may be introduced as the marketplace grows.
8. Reporting to Authorities
Nothing here prevents us from reporting unlawful activity to law enforcement, and it does not replace your ability to contact authorities directly where appropriate.
9. Changes
We may update these Rules. Material changes will be communicated through the Service. Continued use after changes take effect constitutes acceptance.

Porch Pick Buyer Protection & Dispute Policy

1. What This Policy Covers
Porch Pick offers Buyers a way to report a problem with an order and request a resolution. This is Porch Pick's own protection process. It is not insurance and is separate from any payment-card chargeback right you may have with your bank (see Section 8).
2. When You Can Open a Case
You may open a case as the Buyer of an order once the order is marked delivered (or completed). Sellers cannot open cases. Only one active case may exist per order at a time.
Eligible reasons (you choose one when opening a case): - Not as described — materially different from the listing; - Damaged — arrived damaged in a way not disclosed; - Not received — the order shows as delivered, but you did not receive it; - Wrong item — a different item was sent; - Counterfeit — the item is a suspected counterfeit; - Other — another problem, which you describe.
If your order never arrives. If tracking never shows delivery, you do not need to open a case: the Seller is not paid (funds are released only after confirmed delivery), and if the Seller does not ship within 7 days the order is automatically cancelled and you are refunded. If a shipment appears lost in transit, contact support@porchpick.com and we will resolve the order, including refunding you where appropriate.
When you open a case you select a reason and provide a written description of the problem. Photo uploads are not supported in the app yet, so please describe the issue in as much detail as you can.
Filing window. A case must be opened within 3 days of delivery. After that window closes — or once you accept the delivery, which releases payment to the Seller — contact support@porchpick.com and we will help where we can.
3. What Happens While a Case Is Open
- The order's payout to the Seller is paused — funds are not released to the Seller while a case (or a chargeback) is open, even if the normal post-delivery hold period would otherwise have elapsed.
- The Seller is notified that a case was opened.
- You and the Seller can continue to communicate through the order's messages while the case is open. Messaging is disabled once the case is resolved (not when it is opened).
4. How Cases Are Reviewed and Resolved
Cases are reviewed and resolved by Porch Pick staff. There is no automated decision-making in this process.
Review timing. We aim to review most cases within a few days of filing. Review times are not guaranteed and may be longer during busy periods.
Possible outcomes. After review, Porch Pick may: - Full refund — refund the entire order to your original payment method and cancel the order; - Partial refund — refund part of the order to your original payment method; - Return required — ask you to return the item; note that a return-shipping label is not generated automatically today, so return instructions will be provided separately; - Seller warning — record a warning to the Seller without a refund; - No action — close the case without a refund if it is not substantiated.
Refunds are issued through Stripe to your original payment method and may take several business days to appear. Where the Seller had already been paid, Porch Pick reverses the corresponding transfer (in full or in proportion for a partial refund).
Finality. A resolution decision is final for purposes of this policy, subject to the dispute-resolution terms of the Terms of Service.
5. Automatic Order Protections (Not Cases)
Separate from cases, the platform applies automatic protections: - Seller shipping deadline. If a Seller does not ship within 7 days, the order is automatically cancelled and you are refunded. - Delivery hold. After delivery, the Seller's payout is held for 3 days before release, giving you time to inspect and, if needed, open a case. You may release payment to the Seller sooner by accepting delivery. - Cancellation window. You may cancel an order yourself within 3 hours of purchase, before it progresses — and again at any point once the Seller has gone 7 days without shipping.
6. Buyer Responsibilities and Abuse
You agree to open cases in good faith and to provide accurate information. Abuse — including false claims, or failing to return an item when a return is required — may result in denial of the case, reversal of any refund already issued, and account action under the Marketplace Rules and Terms of Service.
7. What Is Not Covered
Buyer Protection does not cover: normal, disclosed wear on pre-owned items; minor variations that were disclosed or reasonably expected; buyer's remorse; items altered or damaged after delivery; or issues reported after the order has closed (payment released to the Seller). Off-platform transactions are not covered at all.
8. Card Chargebacks (Separate from Cases)
If you dispute a charge directly with your bank or card issuer (a "chargeback"), that is a separate process initiated at your bank, not within the app. When Porch Pick receives notice of a chargeback, the order's payout is paused and the matter is handled through your card network's process. Filing both an in-app case and a chargeback for the same order may delay resolution. Chargebacks are recorded and may affect your account standing.

Porch Pick Seller Policy

1. Who Can Sell
To list items and receive payouts you must be 18 or older, have a registered Porch Pick account, and complete payout onboarding with our payment processor, Stripe (Section 4). You may sell only children's and baby clothing, footwear, and clothing accessories such as hats and bonnets (no bedding, cribs, car seats, toys, furniture, or baby gear) that comply with this policy, the Marketplace Rules, and the Terms of Service.
2. Listing Your Items
You are solely responsible for your listings. You agree that each listing: - accurately describes the item — brand, size, condition, materials, measurements, and any flaws — and uses your own photos of the actual item; - is for an item you own and may lawfully sell, that is authentic (not counterfeit or replica); - complies with the safety requirements for children's goods in the Marketplace Rules (no recalled items, no unsafe sleepwear, no choking/strangulation hazards, etc.).
Listing details are entered by you; Porch Pick does not auto-generate or verify them. Porch Pick does not pre-screen or authenticate listings (see Section 10).
3. Fees
Porch Pick charges Sellers a fee on each completed sale: - 15% of the item price for items priced over $15, or - a flat $2.50 for items priced $15 or less,
calculated on the item price (after any bundle discount) and deducted from your payout. Buyers pay a shipping charge of $7.50 for the first item plus $1.00 per additional item in the order and no separate marketplace fee. You may enable Free Shipping on a listing: the Buyer then pays $0 shipping and the shipping cost is deducted from your payout for that order (your payout will not go below $0). Fees are shown before you list and may change on a going-forward basis with notice.
4. Payouts (Stripe Connect)
4.1 Onboarding. Payouts are handled through Stripe Connect (Express). You must complete Stripe's onboarding and accept the applicable Stripe Connected Account Agreement. Identity and financial details required for payouts — legal name, date of birth, tax identifier, and bank account — are collected and verified directly by Stripe, not stored by Porch Pick.
4.2 When you get paid. After an order is delivered and the 3-day post-delivery hold passes with no open case or chargeback, your net proceeds (sale price minus Porch Pick's fee) are transferred to your Stripe balance. A Buyer may release funds earlier by accepting delivery. Withdrawing from your Stripe balance to your bank is a separate step you initiate; Porch Pick does not control bank-transfer timing.
4.3 Reversals and negative balances. If an order is refunded or a chargeback is lost after you were paid, Porch Pick reverses the corresponding transfer (in full, or proportionally for a partial refund). You are responsible for resulting negative balances, and you authorize recovery from current or future payouts.
4.4 Taxes. You are responsible for your own taxes on your sales. Where required, sales tax is calculated and remitted through Stripe Tax under marketplace-facilitator rules. Tax forms (e.g., 1099-K), where applicable, are issued by Stripe. Nothing here is tax advice.
5. Shipping (Shippo)
When an item sells, a prepaid Shippo shipping label is made available to you. You must: - ship within 7 days — if you do not, the order is automatically cancelled and the Buyer refunded, and repeated failures may lead to account action; - ship the item, in the condition described in your listing, to the address provided using the designated label; - provide accurate package weight and dimensions — carriers may assess adjustments or surcharges for inaccuracies, and you authorize Porch Pick to bill those back to you, including by deducting from payouts.
Risk of loss, delivery timing, and handling of undeliverable packages are subject to the carrier's terms.
6. Offers, Promotions, and Selling Formats
- Offers. Buyers may make offers on your listings; you can accept, decline, or counter, and you may send offers to users who saved or liked a listing. Offers expire after a period shown in the app; an accepted offer is a binding commitment to sell at the agreed price.
- Promoted listings and other formats. Membership or other features may let you promote listings or use additional selling formats (e.g., auction-style listings). Additional rules for those features are shown in the app.
7. Reviews
After a completed order, the Buyer may leave a public rating and review of you as the Seller. Reviews feed into Seller statistics and badges. You may not solicit false reviews or retaliate; reviews are subject to the Marketplace Rules.
8. Order Cancellations and Refunds
Orders may be cancelled or refunded as described in the Buyer Protection & Dispute Policy — including automatic cancellation for missed shipping deadlines, Buyer self-cancellation within the allowed window, and case resolutions. When an order is refunded, the associated item may be relisted, and any payout already made to you may be reversed.
9. Enforcement
Porch Pick does not pre-screen listings. We act on reports and behavioral signals: we may remove listings, issue warnings, and restrict your ability to list, message, or buy, or suspend your account, based on user reports reviewed by our staff or automated rules that act on transactional signals (such as disputes, refunds, reports, cancellations, and failed payments). Restrictions and suspensions are described in the Marketplace Rules. Prohibited conduct includes fee circumvention, off-platform solicitation, misrepresentation, and listing prohibited or unsafe items.

Porch Pick Copyright & DMCA Policy

1. Our Policy
Porch Pick respects intellectual-property rights and expects its users to do the same. Listing counterfeit goods or posting content that infringes another's copyright or trademark violates the Terms of Service and Marketplace Rules. We respond to valid infringement notices under the Digital Millennium Copyright Act (DMCA) and may remove content and terminate repeat infringers.
2. Reporting Copyright Infringement (DMCA Notice)
If you own a copyright (or are authorized to act for the owner) and believe content on Porch Pick infringes it, send a written notice to our Designated Agent (Section 5) that includes: 1. your physical or electronic signature; 2. identification of the copyrighted work claimed to be infringed; 3. identification of the allegedly infringing material and enough information for us to locate it (e.g., the listing URL or ID); 4. your contact information (name, address, telephone, email); 5. a statement that you have a good-faith belief the use is not authorized by the owner, its agent, or the law; and 6. a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.
Incomplete notices may not be actionable. Knowingly making a material misrepresentation may subject you to liability under 17 U.S.C. § 512(f).
3. Our Response and Counter-Notice
On receiving a valid notice, we may remove or disable access to the material and notify the user who posted it. If you believe your content was removed by mistake or misidentification, you may submit a counter-notice to the Designated Agent that includes: 1. your physical or electronic signature; 2. identification of the removed material and its prior location; 3. a statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification; 4. your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your district (or, if you are outside the United States, the United States District Court for the Middle District of Alabama) and that you will accept service of process from the party that submitted the original notice.
If we receive a valid counter-notice, we may restore the material in 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the activity.
4. Repeat Infringers; Trademark and Counterfeit
We terminate, in appropriate circumstances, the accounts of users who are repeat infringers. Counterfeit items and trademark-infringing listings are prohibited; report them through the in-app report tool (reason "Counterfeit") or, for a formal IP complaint, to the Designated Agent.
